By using our Managed DNS services, you agree to these Terms, in addition to the General Terms & Conditions, Acceptable Use Policy (AUP), and any applicable Service Level Agreement (SLA).
1. Service Overview
SwishHost Managed DNS services provide advanced domain name system (DNS) management to optimize website performance, reliability, and security. Features include global load balancing, DDoS protection, and customizable DNS configurations.
2. Eligibility
To use our Managed DNS services, you must:
- Be at least 18 years old.
- Have a valid SwishHost account.
- Comply with all applicable laws and these Terms.
3. Service Features
- Global Load Balancing: Distribute traffic across multiple servers to improve performance and redundancy.
- DDoS Protection: Mitigate DNS-based attacks to ensure uptime and reliability.
- Custom DNS Records: Manage A, AAAA, CNAME, MX, TXT, and other DNS record types.
- Real-Time Updates: Quickly propagate DNS changes across the network.
4. Acceptable Use Policy (AUP)
In addition to the general AUP, the following specific provisions apply to Managed DNS services:
- Prohibited Uses:
- Hosting or pointing DNS records to malicious content, such as phishing sites or malware.
- Using DNS services to facilitate illegal activities or violations of intellectual property rights.
- Resource Abuse: Activities that disrupt the performance or stability of SwishHost’s DNS infrastructure are prohibited.
5. Service Availability and Performance
- SwishHost strives to provide 99.99% uptime for Managed DNS services, as outlined in the SLA.
- Temporary disruptions may occur due to scheduled maintenance or unforeseen technical issues. Advance notice will be provided for planned outages.
6. Billing and Payments
- Managed DNS services are billed on a recurring basis based on the selected plan.
- Failure to pay on time may result in suspension or termination of services.
- Refunds, if applicable, are subject to our Refund Policy.
7. Customer Responsibilities
- DNS Configuration: Customers are responsible for correctly configuring and managing DNS records to avoid service disruptions.
- Domain Registrations: Customers must ensure that their domains are registered and active to use SwishHost Managed DNS services.
8. Security and Data Integrity
- Access Control: Customers are responsible for securing their account credentials and DNS settings.
- Data Backups: While SwishHost takes measures to secure DNS configurations, customers should maintain their own records for redundancy.
9. Termination and Suspension
SwishHost may suspend or terminate Managed DNS services for:
- Violation of these Terms, the General Terms, or the AUP.
- Non-payment of fees.
- Activities that compromise service integrity or violate applicable laws.
10. Limitation of Liability
To the fullest extent permitted by law, SwishHost is not liable for:
- Loss of data, traffic, or business opportunities due to misconfigured DNS settings or service disruptions.
- Indirect or consequential damages related to Managed DNS services.
11. Amendments to Terms
SwishHost reserves the right to amend these Terms at any time. Changes will be posted on our website, and continued use of the service constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Delaware. Any disputes arising under these Terms shall be resolved in Delaware courts.
