SwishHost Hosted Desktop services provide secure, remote desktop solutions for businesses and individuals. Our plans include access to a cloud-hosted environment with daily backups, Microsoft Office pre-installed, and options for app installation.
2. Eligibility
To use our Hosted Desktop services, you must:
- Be at least 18 years old.
- Have a valid SwishHost account.
- Comply with all applicable laws and these Terms.
3. Service Features
- Hosted Environment: Hosted desktops are provisioned in the country of purchase to comply with data sovereignty requirements.
- Daily Backups: All plans include daily backups to safeguard data.
- Microsoft Office: Installed by default on all plans.
- App Installation: Additional apps can be installed. Fees may apply for Solo and Small Team plans.
4. User Responsibilities
- Account Security: You are responsible for maintaining the security of your login credentials and ensuring only authorized users access the hosted desktop.
- Prohibited Activities: Activities such as illegal content storage, cryptocurrency mining, and misuse of resources are prohibited and may result in service suspension.
- Resource Use: Resource allocation must comply with the limits specified in your plan. Excessive use may result in temporary restrictions or plan upgrades.
5. Acceptable Use Policy (AUP)
In addition to the general AUP, the following apply specifically to Hosted Desktop services:
- Content Restrictions: Users must not store, process, or share data that violates applicable laws or regulations.
- Security Practices: Users must implement secure practices such as using strong passwords and avoiding installation of unverified applications.
6. Service Availability and Performance
- SwishHost strives to maintain 99.9% uptime for Hosted Desktop services, as outlined in the SLA.
- Temporary downtime may occur due to scheduled maintenance or unforeseen issues.
7. Billing and Payments
- Hosted Desktop services are billed on a recurring basis as per the selected plan.
- Failure to pay on time may result in service suspension or termination.
- Refunds, if applicable, are subject to our Refund Policy.
8. Data Backup and Security
- Daily Backups: SwishHost performs daily backups; however, users should maintain their own backups for critical data.
- Data Responsibility: Users are responsible for the content and data stored on the hosted desktop.
9. Termination and Suspension
SwishHost may suspend or terminate Hosted Desktop services for:
- Violation of these Terms, the General Terms, or the AUP.
- Failure to comply with billing obligations.
- Activities that disrupt service integrity or compromise security.
10. Limitation of Liability
To the fullest extent permitted by law, SwishHost is not liable for:
- Data loss resulting from user actions, software issues, or technical failures.
- Indirect or consequential damages arising from the use or inability to use the Hosted Desktop service.
11. Amendments to Terms
SwishHost reserves the right to amend these Terms at any time. Changes will be posted on our website, and continued use of the service constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Kentucky. Any disputes shall be resolved in Kentucky courts.
