SwishHost VoIP services provide internet-based voice communication solutions designed for businesses and individuals. Our VoIP plans include flexible routing options, support for call groups, and compatibility with various software and devices.
2. Eligibility
To use our VoIP services, you must:
- Be at least 18 years old.
- Have a valid SwishHost account.
- Comply with all applicable laws and these Terms.
3. Features and Limitations
- Compatibility: VoIP services are compatible with various softphones, desk phones, and mobile applications.
- Call Groups: Users can set up and manage call groups such as sales or marketing teams for streamlined communication.
- Service Limitations: Emergency calls (e.g., 911) may be subject to limitations depending on your location and device setup. Users are responsible for ensuring their devices comply with local emergency calling requirements.
4. Acceptable Use Policy (AUP)
In addition to the general AUP, the following specific provisions apply to VoIP services:
- Prohibited Uses:
- Spamming, telemarketing, or robocalling without proper authorization.
- Illegal or fraudulent activities using VoIP services.
- Transmission of harassing, obscene, or defamatory communications.
- Fair Usage: VoIP plans are subject to fair usage policies to ensure quality service for all users. Excessive or abusive usage may result in additional charges or suspension.
5. Service Quality and Availability
- While SwishHost strives to provide high-quality VoIP services, service quality may depend on the user’s internet connection and network setup.
- Downtime may occur due to maintenance, upgrades, or unforeseen technical issues. Advance notice will be provided for scheduled maintenance.
6. Billing and Payments
- VoIP services are billed on a recurring basis as per the selected plan.
- Failure to pay on time may result in suspension or termination of service.
- Additional charges may apply for overages, premium features, or international calls not included in your plan.
7. Customer Responsibilities
- Device Configuration: Users are responsible for configuring and maintaining their VoIP-compatible devices and software.
- Call Monitoring: Users are responsible for monitoring and ensuring compliance with local laws regarding call recording and monitoring.
- Emergency Services: Users must ensure their devices are configured for emergency calls where applicable.
8. Data Privacy and Security
- VoIP services transmit data over the internet, which may be subject to interception. SwishHost implements measures to secure communications but cannot guarantee absolute security.
- Users must ensure their devices and networks are secure to prevent unauthorized access or misuse.
9. Suspension or Termination
SwishHost may suspend or terminate VoIP services for:
- Violation of these Terms, the General Terms, or the AUP.
- Non-payment of fees.
- Activities that compromise service integrity or security.
10. Limitation of Liability
To the fullest extent permitted by law, SwishHost is not liable for:
- Loss of business, profits, or data resulting from VoIP service interruptions or misuse.
- Inability to access emergency services due to user misconfiguration or limitations in service.
11. Amendments to Terms
SwishHost reserves the right to amend these Terms at any time. Changes will be posted on our website, and continued use of the service constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Kentucky. Any disputes arising under these Terms shall be resolved in Kentucky courts.
